Consumer Alert

Beware of box companies ("haulers") advertising that they can provide Mountain View with dumpsters, recycling and debris boxes for cleanups, remodeling or demolition projects at residences or businesses. Like most cities in the San Francisco Bay Area, Mountain View has an exclusive agreement to provide these services to our community. The City’s exclusive hauler is Recology Mountain View. In return for this privilege, Recology pays the City a service fee which is returned to ratepayers in the form of lower utility rates.  

Unfortunately, there are haulers who are aware of the law, but illegally provide such services to unsuspecting customers and then refuse to move the box from your property or refund your money. To help prevent consumer fraud, the City has notified haulers that Recology is the City’s exclusive provider of these services and violation is a misdemeanor. Only Recology may place a box on private property or in the public street with an encroachment permit. Why the City Cares

Because the City is responsible for public health and safety, State law allows jurisdictions to control the flow of solid waste and recycling from each property to its final destination to ensure it is handled properly and is not abandoned on a vacant lot or street. This is why the City has exclusive agreements with haulers, processors and landfills. Only the City's exclusive hauler, Recology, may provide you with dumpster or box services, and no other hauler may be used. There are exceptions to State and local laws, such as roofers hauling debris as an incidental part of their total roofing service to you. However, if the roofer subcontracts to a box company, they must use Recology services.

Why Other Companies may offer lower rates

These other haulers may not be fully disclosing their rates or include the disposal fees when advertising a "$79" box. Also, they don't carry the level of insurance the City requires of Recology. It could be difficult to collect from unauthorized haulers if they damage your property or injure someone. It would also be hard to verify where they dispose or recycle your materials. If they take the box to a place outside Santa Clara County, the City loses valuable tax revenue.  Such haulers are also cheaper because they don't pay the City a service fee.

Because the City is responsible for public health and safety, we have an exclusive agreement with Recology and require Recology to carry certain insurance levels. The City has Recology take all wastes to the SMaRT Station to ensure maximum recycling before disposal. The costs of recycling are included in the City's rates. Once a year, the City sets rates at a public hearing and offers discounts for recycling boxes of yard trimmings and cardboard. Rates cover the costs of hauling, recycling processing and disposal. In return for the exclusive agreement, Recology pays the City a service fee which is used to keep utility rates low. When customers use illegal haulers, they are hurting City revenues used to keep all utility rates low. 

Why Companies Violate the Law

Some haulers (or the contractors who hire them) may not be aware of the City's exclusive agreement with Recology, while others are fully aware and continue to sell consumers these services fraudulently. To help prevent consumer fraud, the City has notified all haulers that Recology is the City's exclusive provider of these services and violation is a misdemeanor. Despite these warnings, some haulers continue to violate the law because they benefit financially. Once caught, they may refuse to remove the box from your property until you pay for services.  If you are unsure if a hauler is operating legally, or you want to know about certain exceptions, please do not hesitate to contact either Recology at (650) 967-3034 or the City Solid Waste & Recycling staff at (650) 903-6311. Exceptions to Using the city's Exclusive HaulerRecology truck

Recology Mountain View is the City’s exclusive hauler for collection of the community's garbage, recycling and yard trimmings, including roll-off box services. Please note that if your general contractor uses a roll-off box hauler, it must be Recology. No other roll-off box hauler may be used for recycling or disposal.

Per City Code, no other roll-off box hauler may be used unless:

  • The materials are self-hauled by a State-licensed general construction contractor, working at the site, who owns and hauls their own box or truck, and the hauling is an incidental part of total services (e.g. roofers, landscapers); or
  • The generator sells or donates their materials to a recycling hauler or processor, provided:
    1. they do not require payment of any kind for the collection, transportation, transfer or processing;
    2. materials are kept source-separated on site (i.e. box of metal, box of drywall); and
    3. the hauler has both a business license and a City Franchise.
      All three conditions must be met, and no payment of any kind can be made by the consumer to the company for these services even after any recycling revenue is credited.
